Section 16
Treatment expenses

(1) The Attorney General shall receive the following treatment expenses in case of illness:-
(a) Expenses incurred during hospitalization and treatment as per the hospital bill and medication expenses purchased as per the prescription of the hospital doctor. But the doctor's prescription must have been diagnosed (diagnosis).
(b) Expenditure according to the bill incurred for all types of chirfar (surgical operation) except plastic surgery. But the expenses incurred in a private nursing home will not be given.
(c) Expenses for glasses, teeth, earphones, etc. from the amount specified by the Government of Nepal according to the bill.
(2) Notwithstanding anything contained in sub-section (1), the amount of medical expenses received by the Attorney General throughout his tenure shall not exceed an amount equivalent to twelve months' salary.
(2a) If the attorney general's spouse, mother, father, son or daughter is sick, the attorney general shall be entitled to receive ninety percent of the medical expenses billed as per the bill by deducting from the amount of the maximum medical expenses to be received according to sub-section (2). When claiming such treatment expenses, the doctor's certificate of diagnosis must be submitted. But the medical expenses to be received according to this sub-section shall not exceed one month's salary of the Attorney General at one time.
(2B) When the Attorney General's husband or wife, mother, father, son or daughter is sick and gets treatment abroad, or when he is admitted to a local hospital for surgery or treatment, ninety percent of the expenses incurred according to the hospital bill and the medical treatment expenses incurred according to the prescription of the hospital doctor. (2c) Notwithstanding anything contained in sub-sections (2a) and (2b), if the spouse, mother or father, son or daughter of the attorney general is an employee in a constitutional position or in government service or in the service of a government-owned or controlled institution, such medical expenses shall be paid. (2e) The details of the medical expenses received by the Attorney General in accordance with this section shall be kept in the leave records and personal records of such Attorney General.
(3) If the committee of doctors appointed by the Government of Nepal recommends that the Attorney General cannot receive medical treatment within Nepal, and if he wishes to go abroad for treatment, the Government of Nepal may give the Attorney General additional financial assistance as deemed appropriate by the Government of Nepal in addition to the treatment expenses to be received according to sub-section (1). br> (4) At the time of separation from the service, the Attorney General shall be entitled to receive a lump sum of two-thirds of the remaining medical expenses, with or without taking some of the medical expenses received under sub-section (2). But the Attorney General who retires from service by receiving pension will be entitled to receive the entire amount as a lump sum.
(5) Notwithstanding anything written in sub-section (4), when giving medical expenses to an Attorney General who retires from service without serving five years in the position of Attorney General, the total amount of medical expenses to be received according to this Act shall be given only the amount that will be paid by Damasahi considering the amount received for five years of service.< br> (6) If the Attorney General dies before being able to receive the medical expenses due under this section, the person who is determined to receive family pension or gratuity according to section 18 will be entitled to receive the medical expenses.
